1. Terms and conditions applicable to the CanaPlay website

These terms and conditions apply to all online transactions with CanaPlay (Aurélie Collart). All contracts are governed by and construed in accordance with Belgian law, and any dispute between us is subject to the exclusive jurisdiction of the Belgian courts. Nothing in these terms and conditions shall be deemed to affect your statutory rights.

By using this site, you agree to these terms and conditions, and all transactions with CanaPlay are governed by these same terms and conditions.

Any reference to the "company" or "we" means a reference to CanaPlay. Any reference to the "customer" refers to the person or persons who purchase or agree to purchase goods from the company. Any reference to the website includes a reference to all URLs owned by CanaPlay.

2. Price

All prices are displayed in euros and include VAT at the current rate, unless otherwise clearly stated. Offers and prices from CanaPlay are valid while displayed and subject to availability. All prices are subject to change without notice.

3. Ordering and Payment Process

The ordering process on the CanaPlay website (www.canaplay.shop) is as follows:

You select the items you wish to order and add them to your cart. On the cart page, you can then click the "Place Order" button. To proceed with your order, you must log in or create an account on the website's online store. Some contact information will be requested to process your order.

Delivery is free to your home via DPD (for France and other European Union countries) or Visutrans (for Belgium). There are no additional charges. Your order will only be valid once you have provided this information, read and accepted the terms and conditions, and successfully completed payment by clicking the order button labeled "Pay" through the Wix Payment system. The payment process is completely secure. You can modify your order at any time before final confirmation.

Once payment is complete, you can print your order details and track its status in your personal account. An order confirmation email will be automatically sent to you, summarizing your order details. This confirmation email does not constitute acceptance of your order; it simply confirms that we have received it.

You will then receive an email confirming shipment of your products, including a tracking link. Delivery of the products constitutes acceptance of your order. Delivery will only be made after receipt of payment.

We reserve the right to refuse your order under the following circumstances:

– the products are unavailable or sold out;

– the products are presented incorrectly and invalidly in the online store;

– serious doubts arise regarding abuse of rights or bad faith on the part of the client;

– a case of force majeure occurs.

In the event that we do not execute the order, the customer will be informed as soon as possible.

If you pay for your transaction with a credit or debit card, your order is not complete and the contract between us is not final until we receive authorization from the card issuer. We accept Visa, MasterCard, and Maestro (Bancontact) from most major European banks, as well as payments via PayPal and Google Pay. We cannot be held responsible for delays in delivery and/or non-delivery of your order due to your card issuer's refusal to authorize your payment. Orders not accompanied by a valid payment in the cardholder's name will not be accepted or processed.

To place an order, you must be at least 18 years old. If you are under 18, please have your parents or legal guardian place the order. We reserve the right to refuse any order that we determine has been placed by a minor.

4. Delivery

All goods and services are delivered to the address you provide when placing your order. If the address you provide is incorrect, it will be your responsibility and may result in additional charges.

During the ordering process, you will be informed of any applicable shipping costs. These are calculated definitively at the end of the ordering process, before the "Proceed to payment" step and before the payment is processed by Wix Payment.

The risks associated with the product will be transferred to you upon delivery to the address you provided. From that point onward, we accept no liability for any loss or damage to the product.

Products are delivered, whenever possible, within 2 to 7 business days in Western Europe after order confirmation. If we are unable to deliver within this timeframe, we will inform you as soon as possible. Under no circumstances will any delay give rise to compensation. In the exceptional case where we are unable to deliver the order within 30 days of order confirmation, you may cancel the sales contract by contacting our customer service department. The ordered products will be fully refunded (including shipping costs if you paid for them) within 30 days.

You must ensure that the products meet your needs and expectations. We do not guarantee that the products will meet your individual requirements. The products are standard and have not been custom-designed. For any questions, please contact our customer service department.

In the event that the products are damaged during transport or that the delivered products differ from the products ordered, you are required to notify us as soon as possible and in any case within 3 days, by contacting our customer service.

We accept no liability for any indirect damage caused by late delivery or non-delivery by DPD or Visutrans. In such cases, our liability is limited to the value of the items that are proven not to have been received by the customer.

Our shipments are always made at our own risk. Therefore, you don't need to worry if any items are lost in transit. However, if you return items within 30 days of purchase because you no longer wish to keep them, you are responsible for their return shipping.

If the goods delivered by us are damaged during transport, do not correspond to the items listed on the delivery note, or do not correspond to the items you ordered, you are required to notify us as soon as possible and in any case within 3 days, and to return the items to us within 30 calendar days of receipt. 5. Returns and exchanges

We want you to be completely satisfied with every purchase made from the CanaPlay website, and we do everything we can to offer you quality products and service at all times.

If you wish to return your purchase, you will be responsible for the return shipping costs. You can choose between a refund or a return in exchange for a voucher valid online.

Since some products no longer fit in their box once unpacked (vacuum-sealed packaging), we will coordinate the return with you. To initiate a return, please contact our customer service department at info@canaplay.shop or CanaPlay, Customer Service, Rue du Platoit 11, 7190 Ecaussinnes, Belgium.

Please clearly indicate your order number on the box so that our warehouse can identify your return.

In the case of a full or partial return for a refund, we will refund the total amount of the order. The refund will be processed within 14 days of receiving the returned items and will use the same payment method used by the customer for the initial transaction.

If you wish to exchange an item, a voucher for the value of your item will be sent to you as soon as we receive your return so you can place your order again. The voucher can be used on any purchase of at least the voucher's value.

In any event, the items must be returned to us in their original condition within 30 days from the date of delivery.

6. Products

Unless otherwise stated, products are sold individually and are not always available. If one or more items are unavailable at the time of order placement, we will unfortunately be unable to fulfill the entire order.

We always describe what we sell and how the ordering process works as fully and accurately as possible. The description is always detailed enough to allow you to properly assess the product. If we use illustrations, they accurately represent the items offered. However, mistakes can happen, so if it becomes clear that we have made an error, we are not obligated to provide you with an item that matches the illustration. Photos are for illustrative purposes only.

CanaPlay guarantees that the product will be delivered in perfect condition and conforms to the manufacturer's specifications. Use of the product must follow the manufacturer's published instructions, as described in the product description. You must ensure that you use the product in accordance with these instructions.

We strive to deliver products to you in perfect condition. However, if you report a product as faulty, you agree to keep the product in its current condition so that we can examine it within a reasonable timeframe. We may require your assistance and certain product information, including details of how the product is believed to be damaged or faulty, and other necessary information, to provide a prompt solution to the faulty product.

In the event that we find that the product has been misused, abused or neglected, including accidents, damage resulting from an attempt to modify or repair it, damage due to normal wear and tear, and any other action inappropriate to its use as recommended by the manufacturer, and this after delivery, CanaPlay reserves the right not to replace or refund the product.

7. Conformity and warranty

We guarantee that our goods conform to your order and meet the normal expectations you may have, given the product specifications. We also guarantee, of course, that our goods comply with all laws in force at the time of your order.

Regarding the delivery of goods, we also apply the minimum legal warranty period of two years if the goods do not conform to the order placed. This warranty means that any goods with defects or faults will be repaired or replaced free of charge for up to two years after delivery.

To the extent possible and reasonable, you have the choice between repair or replacement. You are only entitled to demand a price reduction or cancellation of the sales contract if repair or replacement proves excessive or impossible, or if it cannot be carried out within a reasonable timeframe.

Any defect or flaw that appears within 6 months of delivery is presumed to have existed before delivery, unless we can prove otherwise. After 6 months, the burden of proof rests with you to demonstrate that the defect existed before delivery.

8. Regulations applicable to telesales

You have the right to cancel your order within 30 calendar days from the day after the delivery date for any unused item purchased via the website, in accordance with the regulations applicable to telesales for a refund.

To cancel an order, please email us at info@canaplay.shop, including your customer number and order number. Please take care when returning the items. Goods must be returned within 14 days of your cancellation notice. Returns can be made to our customer service department. Return shipping costs are your responsibility unless the items are deemed faulty or incorrect, in which case we will refund your return shipping costs upon receipt of the returned goods. Provided the goods are returned undamaged with all accessories, you will receive a refund within 30 days of your cancellation notice.

9. Force majeure

We cannot be held liable for any failure to fulfill our obligations caused by or resulting from labor disputes or any other circumstances beyond the company's reasonable control, such as acts of God, riots, civil unrest, floods, fires, strikes, lockouts, difficulties in obtaining transportation, or legislative issues. If any of these circumstances prevent the company from delivering all or part of the ordered items within a reasonable timeframe, the customer's liability is limited to the value of the items supplied and the associated delivery charges.

10. Contents

Any information displayed on our website(s) or other company publications is not considered authoritative or certified as best practice and should be considered only as useful supplementary information to other certified codes of practice. All information on our website is regularly updated.

11. Pricing and printing errors

Prices and specifications are verified to the best of our ability, and while every effort has been made to ensure their accuracy, no liability will be accepted for errors or omissions. We reserve the right to change our prices and specifications without prior notice.

12. Ownership of property

All items delivered to the customer remain the property of CanaPlay until final and full payment of all sums due for these goods.

13. Complaints

Any complaint, or compliment, can be sent to our customer service department (info@canaplay.shop). We will strive to process your complaint within 5 business days of receipt. Should we be unable to resolve your complaint immediately, we will inform you of the likely time required to resolve the issue and will keep you updated on any investigation.

15. Intellectual Property

Our website, logos, texts, photos, names, and, in general, all our communications are protected by our intellectual property rights, those of our subcontractors, or other rights holders. It is prohibited to use and/or modify the intellectual property rights described in this article. Therefore, it is prohibited to copy or reproduce designs, photos, texts, logo color combinations, etc., without our prior express written authorization.

16. Right of withdrawal

If you purchase products from us, you have 14 days from the date of delivery to decide if you do not wish to keep them. In this case, you can return the order without penalty or having to justify your decision (return shipping costs are your responsibility). If you return your order or wish to cancel the contract within 14 days of placing your order, we will refund the full purchase price using the same payment method you used. The direct costs of returning the goods are therefore your responsibility. We will inform you of the return shipping cost or, if it is not reasonably possible to determine it beforehand, we will provide you with an estimate.

We have the right to wait until we have received the goods back or until you have proven that you have returned them, whichever of these two events occurs first, before proceeding with the refund.

For the first 14 days after delivery, we expect you to handle the order and packaging with care. If you wish to return the goods according to the procedure described above, you may only unpack or use them to the extent necessary to assess whether you wish to keep them. Returned goods may have been tried on, but not used. Where possible, returned goods should be placed in their original packaging and include all accessories that were delivered. They must be in their original condition, in accordance with the instructions mentioned below.
